Meridian Add On Special Terms

This document sets out all of Meridian Energy Limited (trading as Meridian)’s (we, our, us, or Meridian) add ons for customers, and any Special Terms that apply to those add ons. Meridian reserves the right to cease offering certain add ons to new customers or premises at any time, without notice.

The Special Terms below are to be read together with Meridian’s Standard Terms and Conditions for the Supply of Electricity (Standard Terms), your Plan Terms, Plan Eligibility Criteria, Add On Eligibility Criteria and any other Special Terms you have agreed in writing with Meridian.  If there are any inconsistencies between the documents, the order of priority set out in clause 1.2 of the Standard Terms will apply.

These Special Terms may be changed in accordance with clause 22.6 of the Standard Terms.

All bolded terms have the meaning given to them in Meridian’s Standard Terms.

When collecting, using and disclosing personal information, Meridian complies with the Privacy Act 2020. Our privacy terms are set out in our Privacy Policy.

Add on eligibility and change

A list of Meridian’s add-ons and the corresponding Special Terms and Add On Eligibility Criteria are set out at https://www.meridianenergy.co.nz/terms-and-conditions/list-of-plans-and-offers.

To be eligible for a Meridian add on, you must meet, and continue to meet, the Add On Eligibility Criteria for that add on. You must promptly notify us if you no longer meet, or expect to no longer meet, any of the Add On Eligibility Criteria.  If we reasonably believe you do not, or will cease to, meet any of the Add On Eligibility Criteria for the add on, we notify you in writing. You will have 30 days from our notice to remedy the issue, unless:

  • (a) we cannot give 30 days’ notice, in which case we will give as much notice as we reasonably can; or
  • (b)  if the issue cannot be remedied.

If you do not remedy the issue within the applicable notice period, or if the issue cannot be remedied, we may terminate your receipt of, or participation in, the add on.

Smart Hot Water Special Terms

(previously called Hot Water Control)

Introduction

1. These Smart Hot Water Special Terms apply to your participation in Meridian's Smart Hot Water (the Programme).

2. Your participation in the Programme will begin on the date we notify you and will continue until we notify you of the end date. We will give you at least 30 days' notice before the end date.

3. Nothing in these Smart Hot Water Special Terms affects the Standard Terms, Plan Terms, or any other Special Terms that apply between you and Meridian, as your electricity retailer, but these Smart Hot Water Special Terms form part of the agreement between you and Meridian.

4. Please note that if you have anything else wired up to the meter that allows us to control your hot water cylinder (for example, underfloor heating or pool heating), this will also be affected.

You give us control of your hot water cylinder

5. By participating in the Programme, you agree that we can turn off supply to your hot water cylinder for up to eight hours a day.

6. If you notice any issues with your hot water cylinder as a result of participating in the Programme, please contact us immediately. We will take reasonable steps to seek to resolve the problem as quickly as possible.

7. We may, from time to time, offer you a credit for participating in this Programme. If a credit has been offered, we will credit your bill with the amount, and at the frequency, notified to you when you join the Programme.

8. We may cease ongoing or recurring credits for existing Programme participants from time to time. We will give you 30 days' prior notice before we do so. If you do not wish to continue in the Programme, you can leave the Programme in accordance with paragraph 13 below.

Your other obligations

9. In addition to your other obligations in these Smart Hot Water Special Terms, you agree to tell us promptly if any of your details or circumstances change (including if you move out of or sell your home, or you change the way you heat your hot water), or if you no longer meet any of the eligibility criteria.

Our liability to you

10. Our liability to you, and your liability to us, is set out in our Standard Terms.

11. Meridian will not be liable to you for any wear or tear of, or any other damage to, your hot water cylinder or other assets that may be connected to the meter that allows us to control your hot water cylinder.

Suspension and termination of participation in the Programme

12. Meridian may suspend or end your participation in the Programme if:

  • we reasonably consider that you are in material breach of these terms. We will give you at least 10 business days' notice. If you have not remedied the issue within that period, or if the issue is not remediable, we may, at the end of that period, suspend or end your participation in the Programme;
  • we reasonably believe that you do not or will cease to meet the Add On Eligibility Criteria for the Programme, in which case the process set out above will apply; or
  • you move out of, or sell, your home;
  • we notify you of the end date of the Programme, in accordance with paragraph 2 above.

13. You may leave the Programme at any time by giving us at least two business days' notice. You may re-join the Programme at any time by giving us at least two business days' notice, provided you meet the Add On Eligibility Criteria.

Rural Supply Partner Special Terms

  1. This add on offer entitles eligible customers to a discount off their electricity bill as agreed between Meridian and each of Ruralco, Farmlands, PGG Wrightson or Farmsource (each a Rural Supply Partner) from time to time.

  2. If you have selected a Rural Supply Partner, you acknowledge that you pay your Meridian electricity bill through the selected Rural Supply Partner and that selected Rural Supply Partner has been appointed as Meridian's billing agent for those amounts. Your Rural Supply Partner is responsible for paying Meridian and assumes any credit risk. If for any reason Meridian's billing agent arrangements with the Rural Supply Partner cease or your receipt of this add on offer is terminated, Meridian may bill you directly for any unpaid amounts.

  3. The payment date for your electricity will be set according to your agreement with your Rural Supply Partner. Their bills to you should specify your due date. We will send you bills for your records only. Ignore the due date on the bills we send to you and make your payment to your Rural Supply Partner by their bill due date.

  4. You cannot make early or partial payments directly to Meridian. All payments must go through your Rural Supply Partner, unless specifically requested by Meridian or if Meridian bills you directly as set out in paragraph 2 above. Any payment you make to us directly will not be taken into account when we request payment from your Rural Supply Partner.

  5. Any payment terms or extensions need to be arranged directly with your Rural Supply Partner. Meridian generally won't be involved unless there are exceptional circumstances.

  6. This offer is not transferrable, refundable or redeemable for cash.

  7. If you wish to change your selected Rural Supply Partner, you must reapply for this offer.

Deferred Winter Payment Special Terms

  1. Other terms and conditions: The terms and conditions of the Deferred Winter Payment Plan ("DWP Plan") are additional to, and should be read in conjunction with, Meridian's Standard Terms and any other terms and conditions agreed with Meridian. In the event of inconsistency between the DWP Plan terms and conditions and our Standard Terms, the Standard Terms shall prevail.

  2. Eligibility: To be eligible for the DWP Plan, you must be an NZ FARM SOURCE Account Holder and you must pay your Meridian invoices through your NZ FARM SOURCE Account as approved by NZ FARM SOURCE from time to time ("NZ FARM SOURCE Meridian Account Holders") and be a Fonterra Supplier.

  3. NZ FARM SOURCE as billing agent: You acknowledge that as an NZ FARM SOURCE Meridian Account Holder, NZ FARM SOURCE has been appointed as Meridian's billing agent in relation to amounts due by you to us ("Due Amounts" — see clause 4 below).

  4. Due Amounts: Due Amounts means the total of all electricity charges, network charges and any other charges in any billing period owed by you to us, minus any distributed generation payments or customer refunds or any other amounts owed by us to you. The DWP Plan applies to all Due Amounts.

  5. Billing during standard period: Except for during the DWP Period, you will receive an invoice from us on or around the 15th of each month relating to Due Amounts in the previous billing period ("Meridian Invoice") this must be paid to NZ Farm Source by the 20th day of the following month.

  6. Billing during DWP Period:

    • The Deferred Winter Payment period runs from June to September ("DWP Period").
    • During the DWP Period, you will receive an Information Only Invoice stating that the amount outlined on the Information Only Invoice is not payable to NZ FARM SOURCE until the completion of DWP Period which is on or before 20 November of that year.
    • Subclauses above are subject at all times to clauses 8 and 9 below.
  7. All accounts: If you hold more than one account with Meridian, these DWP Plan terms and conditions apply individually to each separate parent account structure so you must sign up each parent account individually. The DWP Plan applies to all electricity connections (ICPs) you may have with us under the same parent account.

  8. Cancellation of DWP: Once you have signed up to the DWP Plan, it will apply every year until you notify Meridian that you no longer wish to be on the DWP Plan or Meridian's agreement with NZ FARM SOURCE ends subject to clause 11. Once you cancel your DWP Plan, DWP will no longer apply and NZ FARM SOURCE will continue to act as our billing agent. You will then be billed in accordance with the standard billing arrangement set out in clause 5.

  9. Switching from Meridian and/or NZ FARM SOURCE:

    • (a) Full switch away from Meridian: If you switch your account from Meridian to another electricity retailer during the DWP Period, subject to subclause (e) below NZ FARM SOURCE will continue to act as our billing agent in relation to the part of the DWP Period that you were a Meridian customer. As soon as practicable after you switch, you will receive your Meridian Invoice relating to all Due Amounts incurred by that parent account prior to your switch. You must pay your Meridian Invoice by the due date stated on the Invoice.

    • (b) Partial switch away from Meridian: If you switch one or more electricity connections within an account from Meridian to another electricity retailer during a DWP Period but one or more electricity connections under that parent account remain with Meridian, you will not be invoiced for any Due Amounts relating to Due Amounts incurred at those electricity connections until the end of the DWP Period.

    • (c) No longer an NZ FARM SOURCE Account Holder: If you cease to be an NZ FARM SOURCE Account Holder during the DWP Period, DWP will no longer apply and subject to subclause (e) below NZ FARM SOURCE will continue to act as our billing agent in relation to the part of the DWP Period that you were an NZ FARM SOURCE Account Holder. We may agree that you pay your electricity account through another partner buying group of Meridian however any previous Due Amounts must be paid in full to NZ FARM SOURCE prior to your new buying group becoming our billing agent. Alternatively, we will invoice you directly for any future Due Amounts.

    • (d) Customer changes in circumstances: If in Meridian or NZ FARM SOURCE's reasonable opinion either believe that you are unlikely to be able to pay your current and/or future Meridian Invoices, then we may cancel your DWP Plan. We will provide you with reasons in writing if this occurs. As soon as practicable after this, you will receive your Meridian invoice relating to all Due Amounts incurred. You must pay your invoice by the due date stated on the Meridian Invoice.

    • (e) Meridian may invoice directly: If any of the situations in subclauses (a), (c) or (d) occur, Meridian and NZ FARM SOURCE may agree that Meridian will invoice you directly for any Due Amounts incurred during the DWP Period.

  10. Signing up during a DWP Period: If you sign up to the DWP Plan during a DWP Period, Meridian does not guarantee that the DWP Plan will apply to any Due Amounts due in the month you sign up.

  11. Cancellation of Deferred Winter Payment: Meridian reserves the right at any time to cancel the DWP Plan and not offer it in future years. Meridian will give you at least one month's written notice (which may be via letter or email) of such cancellation. Subject to clause 9(d), Meridian may not cancel your DWP Plan during the DWP Period. As soon as practicable after Meridian's cancellation, you will receive your Meridian Invoice relating to all Due Amounts incurred prior to cancellation.

  12. NZ FARM SOURCE no longer billing agent: Meridian reserves the right, in accordance with its agreement with NZ FARM SOURCE, to rescind NZ FARM SOURCE's appointment as our billing agent. If this happens we will notify you and will require that you make payment of all Due Amounts, including any amounts incurred during the DWP Period, on the date stated in our next invoice to you. We may continue to offer you the benefits of this DWP Plan. We will also invoice you directly for any future Due Amounts.

  13. Other offers: being on the DWP Plan may affect your ability to accept other offers from Meridian.
